Patna HC grants early bail to ex-Minister of Justice in kidnapping case


Patna High Court has allowed early bail plea for former Bihar Justice Minister and Rashtriya Janata Dal (RJD) leader Kartikey Kumar accused of kidnapping builder Rajiv Ranjan Singh alias Raju.

A Single Judge Bench of Justice Sunil Kumar Panwar passed the order during the hearing of a miscellaneous criminal early bail application filed by Kartikey Kumar aka Kartik Singh aka Master Ji on September 5. The application for early bail was filed by the applicant apprehending his arrest in the eight year-old kidnapping case filed at Bihta Police Station in Patna. Magistrate First Class (Danapur) Ajay Kumar’s court ordered the issuance of a bail warrant against Kartikey on July 17 and an arrest warrant was issued by the court on July 19.

Counsel for the plaintiff argued that the ex-Minister was falsely implicated in this matter because he did not “commit any offense alleged in the history of the prosecution so recounted in the statement under section 164 of the CrPC”.

The ADJ-III Danapur court denied his request for early bail on September 1. Kartikey Kumar resigned on August 31, the day his portfolio was changed from law to sugar cane.

In the six-page order, the court said that the applicant’s wife, Ranjana Kumari, had filed an application with the Patna Zone IG and claimed that her husband was present at the school (Mokama) at the time and date of the abduction incident.

“However, police investigation revealed that Kartikey’s mobile location was found near Hem Plaza in Patna, which is close to the scene of the incident,” the court said, adding that the Patna High Court had , on February 16, 2017, already denied Kartikey’s early bail request and ordered him to go to the lower court.

Even on July 7, 2022, Kartikey applied for leave to withdraw the present application for dismissal from the high court,” the court said, adding that all the developments in the Patna high court had been concealed in the application for release on bail of the petitioner.

Kartikey, a close associate of incarcerated Mokama MP Anant Singh, was in the eye of a storm on the day he was sworn in, as the opposition Bharatiya Janata (BJP) party questioned the decision asking how he had skipped the surrender to take the oath, and the issue snowballed when he received the portfolio of law.
