TN pledged to ban online gambling: Minister of Justice in assembly

The previous AIADMK government had enacted an ordinance banning online gambling ‘in a hurry’, leading the Madras High Court to overturn it, the state’s justice minister says , S Regupathy.

The Tamil Nadu government said on Tuesday March 22 that it was committed to banning online gambling and that every effort was being made to invoke existing laws for this purpose. Chief Minister MK Stalin was fully aware of the evils of online gambling which has destroyed several families, Justice Minister S Regupathy has said. The previous AIADMK government had enacted an ordinance banning online gambling “in a hurry”, which led the Madras High Court to overturn it, he claimed.

“We went to the Supreme Court to uphold the law enacted by the AIADMK government. Hopefully the Supreme Court will deliver a good verdict on the Tamil Nadu Government’s appeal against the Madras High Court order quashing the ban on online gambling,” Regupathy said. the Assembly responding to the Call for Attention motion proposed by AIADMK Leader and Leader of the Opposition K Palaniswami. The minister declined to discuss the matter further as the matter was pending.

Highlighting the issue, former Chief Minister Palaniswami called on the state government to take tough action to ban online rummy as several families were ruined because their youth were gambling and losing hundreds of thousands of rupees in the online game. “Some ended up borrowing huge loans while others committed suicide due to huge losses,” Palaniswami alleged. He recalled that his government enacted an ordinance in 2020 to ban online gambling but it was suspended by Madras HC on August 3 last year.

While overturning it, Madras HC Chief Justice Sanjib Banerjee and Justice Senthil Kumar Ramamoorthy said such a ban would be unconstitutional. The Court observed that the authorization of the legislation can be considered erratic, unreasonable and also excessive and disproportionate. Pointing to all this, the court struck down the amendment as ultra vires the constitution. However, the court noted that despite the bench’s nullification of the amendment, the state government would have to introduce new legislation to regulate online gambling.
